The act provides that a cause of action against a person arising from any act of that person in furtherance of the person's right of petition or free speech under the United States or California Constitution in connection with a public issue, as specified, shall be subject to a special motion to strike, unless the court, after considering the pleadings and supporting and opposing affidavits, determines that there is a probability that the plaintiff will prevail on the claim. The act establishes that a prevailing defendant on a special motion to strike shall be entitled to recover his or her attorney's fees and costs. The act exempts any person serving without compensation as a director or officer of a nonprofit corporation subject to certain provision from a cause of action for monetary damages on account of any negligent act or omission occurring (1) within the scope of that person's duties as a director acting as a board member, or within the scope of that person's duties as an officer acting in an official capacity; (2) in good faith; (3) in a manner that the person believes to be in the best interest of the corporation; and (4) is in the exercise of his or her policymaking judgment.Year: 1992•State: California•Type: Act or Session Law•Source: California Legislature
This act permits 66 of the state's 67 counties (excluding Philadelphia) to raise additional revenues to be used for affordable housing needs by increasing fees for recording mortgages and deeds. This act requires that the additional funds be expended for any program or project approved by the county commissioners which increases the availability of quality housing, either sales or rental, to any county resident whose annual income is less than the median income of the county.Year: 1992•Type: Act or Session Law•Source: Pennsylvania Legislature
