WASHINGTON, D.C. – Today, The United States Supreme Court issued a decision indefinitely blocking the Fifth Circuit Court of Appeals’ order to restrict access to mifepristone by mail in Louisiana v. FDA, allowing mifepristone to remain legal and accessible by mail. Following the lower federal court’s restriction, which required people to obtain the medication in person, rather than online or via telehealth, the Supreme Court subsequently extended a three-day temporary order to allow patients to continue accessing mifepristone pending their final decision. In response, Jennifer Driver, senior director of reproductive freedom & health equity at the State Innovation Exchange (SiX), issued the following statement:
“Today’s decision from the Supreme Court is the decision that should have always been made on behalf of patients and providers – but this is not a permanent solution, and we should not have been in this position to begin with. Mifepristone is safe and effective, and has been proven time and again through rigorous, evidence-based testing. However, we know this fight is not over, and extremists are waiting in the shadows for their next chance to gut access to medication abortion – as they have been doing for years.
“Every time access to this crucial medication is paused by politicians and the courts, it creates chaos, uncertainty, and unnecessary confusion. Providers are being forced to navigate conflicting laws. Patients are left wondering whether they can access care from one day to the next. Hostile states are taking out their draconian laws on the rest. And state legislators who have worked tirelessly to protect reproductive freedom are being told that their laws, their constituents, and their democratic processes do not matter. These are all reasons why a single state and a handful of politicians cannot be allowed to determine health care access for the entire nation.
“State legislators will continue fighting back against these threats until everyone can access this lifesaving medication. We will continue building protections across states, defending providers and patients from criminalization, and ensuring that access to reproductive health care is not determined by the extreme politicians or hostile courts. Mifepristone must be maintained for all who need it – people’s lives are on the line.”
